題外話

早上去寄信(寄義務辯護律師的聲請書)從郵局走出來時，看到有人在推銷慈善小餅乾，想說餅乾小小一包，應該1百元吧，就從錢包拿出100元走過去想說做一下公益，結果一問之下才知道一包200元，只能再掏出一張百元鈔結束這回合0.0，不過推銷的人看起來是有點感動的樣子(?)，離去時，一首老歌在我心中開始迴盪~~掌(漲)聲響起來~~我心更明白~~

一、案由

原檢察官以被告收錢後有拿去幫告訴人買地，進而認定被告有將告訴人投資款項用於本件開發案，客觀上並無施行詐術之行為，而為不起訴處分，告訴人不服，提起再議

二、本律師為告訴人主張如下:

(一)該投資案整體金額高達數億元，且該投資案迄今已7年多，理應有相當數量之計畫書存在，然原不起訴書卻於未要求被告提出該投資案之相關計畫書，據以查證被告有無以假投資案誘騙他人投資資金之假投資真詐騙之不法犯行，即遽採被告辯解而認該投資案存在，自有調查未臻完備之不當。

(二)原不起訴認定被告業將告訴人投資款項全數用於本件開發案，顯然忽略告訴人投資款與該土地價值係落差10多倍以上的明顯事證，遽為有利被告之認定，其認定顯違反常理且有重大瑕疵，顯非可採。

三、案件結果

案經台灣高等檢察署採認本律師上開主張，為再議發回續查之決定。
