商標案件的寫法不同於傳統民刑事案件，比較偏像是在寫作文，一開始因為不太習慣吃足了苦頭，大概花了快3個月才掌握到訣竅

商標案，常見的為註冊商標(核駁先行)、商標評定(商標註冊後3個月內提出)、商標異議(商標註冊後5年內提出)、商標廢止(商標已經沒在用超過3年)

一、案例事實

智財局認定系爭商標之註冊申請案，有商標法第30條第1項第10款之情況，並依此發出核駁先行通知。

二、本律師協助申請人主張如下

(一)按，商標法第30條第1項第10款規定：「相同或近似於他人同一或類似商品或服務之註冊商標或申請在先之商標，有致相關消費者混淆誤認之虞者，不得註冊」。惟其適用要件上除須判斷「商標圖樣是否相同或近似」及「商標所指定商品是否同一或類似」者外，尚須判斷商標在實際使用上「是否有致相關消費者誤淆誤之虞」，合先敘明。

(二)經查，本件商標整體上具繽紛柔美、簡潔舒適之設計感，視覺感受鮮明與活潑，別具創意性，予人一望即得與申請人之商品相連結，具高度之識別性。與引證商標圖樣相較，兩者在整體外觀設計、觀念及字數方面均顯不相同，予人寓目印象實無近似可言。

(三)次查，依異時異地隔離觀察原則判斷，本件商標與引證商標在整體外觀構圖排列、觀念意匠、字數字型方面顯不相同，此外，本件商標圖樣因設計感強烈而富有創意性，消費者當然會對本件商標之留下較深之寓目印象，從而，於購買時施以普通之注意，當可清楚分辨本件商標與引證商標並非來自同一或相關聯之來源，故本件商標與引證商標非屬近似之商標。

(四)就本件商標實際使用態樣以觀，申請人係將本件商標字樣突顯於申請人網站之明顯位置，而供消費者予以辨識，本件商標圖樣足以指示服務來源，具有使一般消費者區辨服務出處，達到重複消費時確認來源之效果，應足以供消費者認識其為表彰服務之標識，並得藉以與他人之服務相區別。

(五)據上論結，本件商標與引證商標整體既不近似，且消費者於購買時施以普通之注意，當可清楚分辨該本件商標與引證商標並非來自同一或相關聯之來源，故該等商標非屬近似之商標。

三、案件結果

案經智財局採認本律師上開主張，為系爭商標准予註冊之處分。
