一、案例事實

參加人以原告之「風扇、馬達及其軸承結構」發明專利(下稱系爭專利)違反核准時專利法第22條第1項第1款、第4項及第26條第2項之規定，對之提起舉發，案經被告經濟部智慧財產局為「請求項2 至3、8、11、13至16、22至23、28、31、33至36、42至43、48、51、53至56舉發成立，應予撤銷」之處分(下稱原處分)，原告不服，提起訴願遭經濟部駁回，遂向行政法院提起行政訴訟。

二、本律師代理參加人主張如下

(一)系爭專利舉發證據之使用，應優先採用內部證據，倘使內部證據未明確界定，再考慮外部證據之使用，先予敘明。經查系爭專利說明書雖記載圓筒狀密封結構23係覆蓋該含油軸承21之一頂面212及一側壁213或至少一部分，惟並無「覆蓋」即為「貼覆」之敘述，對於圓筒狀密封結構與含油軸承頂面間並無不具有間隙之記載，申請專利範圍之圓筒狀密封結構與含油軸承頂面間，對於是否不具有間隙亦未界定；而關於原告所稱之教育部國語辭典記載應屬於外部證據，亦無從將「掩覆遮蓋」推定為全無間隙的貼覆；另查證據4圖式第3、4圖揭示保油蓋43封閉於內含油軸承30之軸套21頂端，除防止飛塵落入軸承30外，亦能減少軸承所釋出之潤滑油受到擋止而不會流失，證據4之開放區間亦不致影響其防止飛塵及潤滑油外漏之主要目的，是以系爭專利所欲達成之目的功效皆已揭示於證據4中。

(二)系爭專利說明書揭示在其他實施例中，軸管32亦可為多組件所組成之軸管，例如軸管32底部具有一開口，該開口係以扣件密封亦可以形成軸管32，惟系爭專利請求項13並未記載「該開口係以扣件密封形成軸管32」特徵，該密封扣件所形成之軸管顯然為其它實施例態樣；另證據4圖式第3圖揭示軸承30底部所接附之基座10雖不具有開口，惟已清楚揭示軸承30之軸套21之底部具有開口，可對應系爭專利請求項13之技術特徵。

(三)系爭專利主要藉由一圓筒狀密封結構以覆蓋含油軸承，以確實阻絕潤滑油滲漏的途徑而防止漏油，進而提升風扇馬達與含油軸承的使用壽命，惟證據1圖式第3至5圖雖揭示徑向軸承14上端設置密封構件18且兩者間具有凹陷部18c，說明書記載製造該軸承單元11，殼體構件20具有無間隙且無縫地緊固徑向軸承14、密封構件18等作用，藉此防止填充之潤滑油洩漏，是以原告所稱證據1密封構件18雖留有間隙(凹陷部18c)，仍不影響該殼體構件20之密封構件18具有防止潤滑油徑向甚至軸向滲漏之目的。又查證據2圖式第1圖已揭示一蓋體46抵接於油封45上端面，該蓋體46與油封45間雖未實質形成一封閉之容置空間，惟蓋體46、油封45及含油套筒軸承34間所形成擴充內徑部46cl，其目的係避免因潤滑油滲漏而導致軸承壽命縮短。準此，證據1、2皆可達成系爭專利確實阻絕潤滑油滲漏的途徑而防止漏油，進而提升風扇馬達與含油軸承使用壽命之目的，原告上開主張，自無理由，堪認證據1、2之組合足以證明系爭專利請求項8、11、28、31、48、51不具進步性

三、案件結果

案經智慧財產法院採認本律師上開主張，駁回原告之訴。
