(一)刑事案件。

(三)領錢車手，通常會論339-4加重詐欺。提供帳戶給他人，通常會論339條之幫助詐欺。
(四)本件係單一案件同時出現兩組人頭帳戶之情況(同時間被騙2次)。
(五)人頭帳戶案的關鍵在於對話紀錄的篩選和整理。解除警示帳戶部分，於拿到不起訴書後，可持該不起訴書，就近找偵查隊填寫表格聲請解除警示帳戶。
移送意旨以被告帳戶列為警示帳戶，認被告涉犯詐欺、洗錢等罪，移送地檢署偵辦。
(一)被告因有資金上之需求，依網路上看到之徵求網路代工之訊息，加該承辦人A之LINE，又，依被告與該承辦人A之LINE對話紀錄、及寄貨單等資料，可證被告以LINE與承辦人A聯繫網路代工事宜，承辦人A要求被告提供帳戶存摺、提款卡之事實存在。
(二)且實際上，衡情茍被告若有提供帳戶幫助他人詐取財物之意(假設語氣)，理應隱匿真實姓名以防警方追查，當無提供以自己名義開立之金融帳戶，並於知悉受騙後即刻前往銀行掛失及前往警局備案，而陷己於遭警循線追查之高度風險。
(三)是依臺灣士林地方法院刑事判決106年度訴字第230號、107年度訴字第154號、107年度訴字第262號刑事判決意旨，應認被告係遭詐騙集團成員佯以網路代工須提供銀行帳戶驗證為由，利用其需錢孔急心態，藉機詐得其帳戶作為詐騙集團之人頭帳戶使用，故難認被告係基於供他人使用之目的，而交付上開帳戶，是難認被告主觀上有幫助詐欺取財之不確定故意。
案經桃園地方檢察署採認本律師上開主張，為被告不起訴之處分。
