智慧財產權是一種由法律創設出來的特殊權利。透過法律，提供創作或發明人專有排他的權利，使其得自行就其智慧成果加以利用，或授權他人利用，以獲得經濟上之回報，藉以鼓勵有能力創作發明之人願意完成更多更好的智慧成果。目前我國保護智慧財產權的法律要包括：專利法（發明、新型、設計）、商標法（商標、證明標章、團體標章、產地標示等）、著作權法（著作人格權、著作財產權）、營業秘密法、積體電路電路布局保護法、植物品種及種苗法、公平交易法（不公平競爭的部分）。由於每個法律所設定的保護目的、保護要件不同，不同的智慧財產將受到什麼樣保護，必須深入了解各種相關的法律，為了取得智慧財產權保護，可能必須以特定的程序向專責機關提出申請，建議您可向相關專業領域的律師諮詢討論。
